JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-11-2017 Heard Mr. Najmul Hoda, the learned counsel appearing on behalf of the petitioner and learned A.C. to G.P.12 for the State.

At the very outset of the argument, it has been pointed out that against the order of punishment, there is a statutory provision of appeal under Section 23 of the Bihar Government Servants (Classification, Control & Appeal) Rules, 2005, on such, the learned counsel for the petitioner seeks permission to withdraw this writ petition with liberty to present the appeal before the competent authority.

Prayer is allowed. The writ petition is disposed of with a direction to the petitioner to present the appeal before the

Patna High Court CWJC No.9563 of 2014 (4) dt.16-11-2017 competent authority who shall dispose of the appeal of the petitioner in accordance with law within four months from the date of presentation of the appeal without unsuiting the petitioner on the ground of limitation.
