Let the defect(s) be removed within four weeks of the complete start of the physical Court in normal course. The petitioner is in judicial custody in connection with Khagaria P.S. Case No.169 of 2022, G.R. No.502 of 2022 instituted under Sections 324, 326, 307/34 of the Indian Penal Code read with Section 3⁄4 of Explosive Substance Act. As per the FIR, it has been alleged that the police got information that bomb has been exploded at Khagaria Bakhri Bus Stand and upon reaching there it was found that three accused persons Satish Sada, Chandan Sada and the petitioner herein had exploded three bombs causing injury to the passerby.

Learned counsel for the petitioner submits that the

No.36547 of 2022(2) dt.19-09-2022 2/3 petitioner as also the other accused persons are poor, paper/garbage picker and in course whereof the aforesaid high decibel crackers came in their hand and got exploded causing injuries to the passerby which accordingly to the medical report annexed with the bail application has been found to be simple in nature. His last submission is that the petitioner is young boy and this is his first implication and has no criminal antecedent.

Considering the fact that the petitioner is 21 years of age, has no criminal antecedent, is in custody since 26.02.2022 and charge-sheet stands submitted, this Court is inclined to grant him privilege of bail.

Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each in connection with Khagaria P.S. Case No.169 of 2022, G.R. No.502 of 2022 to the satisfaction of learned Chief Judicial Magistrate, Khagaria, subject to following conditions:

(i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every

No.36547 of 2022(2) dt.19-09-2022 3/3 date before the Trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail by the Trial court itself; (iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of his bail bonds;

With the aforesaid observations, the bail application is allowed.
