JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 10-02-2016 The present application has been filed for modification of order dated 18.02.2015 passed in Cr. Misc. No. 6244 of 2015 for extending the period of surrender. It appears that the petitioner was initially granted anticipatory bail on 12.03.2013 vide Cr. Misc. No. 44192 of 2012 in connection with Khagaria (Gangour) P.S. Case No. 194 of 2012, pending in the court of learned Chief Judicial Magistrate, Khagaria but the petitioner did not surrender within 12 weeks and subsequently Cr. Misc. No. 6244 of 2015 was filed for extending the period of surrender when the period of surrender was extended by four weeks from the date of receipt/production of a copy of the order vide order dated 18.02.2015. But now the second modification application has been filed with a prayer to extend the

Patna High Court Cr.Misc. No.5402 of 2016 (2) dt.10-02-2016 2/2 period of surrender.

Since the initial order was passed in 2013, this Court is not inclined to extend the period of surrender, hence, the initial order dated 12.04.2013 passed in Cr. Misc. No. 44192 of 2012 is hereby rescinded.

Let the learned court below consider the prayer for regular bail of the petitioner keeping in view of the fact that the petitioner was granted anticipatory bail on merits, if the petitioner surrenders before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order.

Accordingly, this modification application is disposed of.
