Patna High Court CWJC No.1318 of 2021(2) dt.23-03-2021 2/3 the following reliefs:- I. Commanding the respondents 1st set and more particularly respondent no. 4 to get the encroachment over public land which is part of public road bearing plot no. 913 in front of plot no. 1291 in village Baldiha, P.S. Taraiya, Distrit Saran removed within a time period as stipulated by this Hon'ble Court as mandated under the provisions of the Bihar Public Land Encroachment Act, 1956;
II. Commanding the respondents 1sr set to demolish any constructions made pursuant to aforesaid encroachment and clear the entire stretch of road in front of S.S. Plot no. 1291 of any obstruction;
III. Commanding the respondents 1st set to ensure that no further encroachment is made over the aforesaid stretch of road in future.
At the outset, the learned counsel for the petitioners submits that in view of the provisions contained in the Bihar Public Land Encroachment Act, 1956, the petitioners shall approach the Circle Officer, Amnaur Anchal, At, P.O. and P.S. Amnaur, District Saran with regard to their aforesaid grievances. Accordingly, the present petition stands disposed of with liberty to the petitioners to approach the Circle Officer,
Patna High Court CWJC No.1318 of 2021(2) dt.23-03-2021 3/3 Amnaur Anchal, District Saran for redressal of their grievances and in case the Circle Officer, concerned finds any merit in the contention of the petitioners, appropriate action shall be taken in accordance with the provisions contained in the Bihar Public Land Encroachment Act, 1956, expeditiously, preferably within a period of six month from the date of filing of such petition by the petitioners.
