2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 25(1-b)a, 26 of the Arms Act.

3. As per FIR, one person was apprehended by the police with one loaded pistol who disclosed the name of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the petitioner has been made accused in this case on the basis of confessional statement of co-accused. He submits that no incriminating article has been recovered from the possession of the petitioner. He further submits that petitioner has two criminal antecedents as stated in para-3 of the

Patna High Court CR. MISC. No.39626 of 2024(2) dt.10-07-2024 2/2 bail application.

5. Learned APP for the State opposes the prayer for bail.

6. Considering the facts and circumstances of the case and the fact that the petitioner has criminal antecedent, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Chakia P.S. Case No. 348 of 2023.
