ANJANA MISHRA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Maharajganj P.S. Case No.46 of 2019 for allegedly having committed the offence under Sections 379 and 511of the Indian Penal Code.
Learned counsel for the petitioner submits that the name of the present petitioner was taken by one Niraj Patel, who was arrested from the place of occurrence. He further submits that the present case is one of false implication and the petitioner cannot be prosecuted on the basis of the statement made by co-accused, which has no evidentiary value. It is further submitted that the petitioner has no criminal antecedents.

No.34054 of 2019(2) dt.23-05-2019 2/2 34052 In view of the aforementioned facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Siwan, in connection with Maharajganj P.S. Case No.46 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Anjana Mishra, J) PNM U T
