JUSTICE SATYAVRAT VERMA ORAL ORDER 01-12-2022 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 406, 420 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and prosecution story is that the petitioner who is sister of the informant's husband along with co-accused cheated the informant and her husband, and got Rs. 14,58,000/- transferred in the account of her husband accused Narayan Dutt Tiwary along with cash on the pretext of providing land but later denied. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that since the informant was not able to pay Rs.

No.37096 of 2022(2) dt.01-12-2022 2/2 2,40,000/- at the time of registration as such the deed could not materialise, it is also submitted that the land belongs to Sabhapati Paswan and the husband of the petitioner was a mediator in the deal. It is further submitted that since her husband was a mediator in the deal as such the informant has also implicated her. Learned counsel for the informant submits that he, for the present, is not opposing the anticipatory bail application of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ara Nawada P.S. Case No. 1110 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Rishabh/- U T
