JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

The prosecution case is that the miscreants snatched the black color bag of the informant containing mobile, ATM card and Rs. 800/-. Subsequently, the petitioner was arrested in Ballia P.S. Case No. 104 of 2013 where the petitioner also made confession about participating in the present occurrence. It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled. Considering the fact that the other case was also registered under Section 392 of the Indian Penal Code wherein it
