ANJANA MISHRA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 420 of the Indian Penal Code.

Learned counsel for the petitioners submits that though these two petitioners are said to have participated in the negotiations for execution of a sale deed for sale of a land belonging to one Md. Umar, no specific allegation is against them. The allegation is that they have stated that the land is not a disputed one and that some money exchanged hands in their presence.

Taking into consideration the fact that the agreement for sale is between one Md. Umar and not against these two petitioners and

No.5183 of 2016 (2) dt.19-02-2016 P2/2 that there is no further allegation against them and also that the agreement can well be executed by moving an appropriate court in a civil proceeding, let the petitioners abovenamed, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Patna, in connection with Phulwarisharif P.S. Case No. 384/2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
