The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and Sections 25(1-b)a/27/35 of Arms Act. The prosecution case as per F.I.R is that all the accused persons including petitioners, came and fired upon the son of informant, which does not hit. Two persons were appreheded from the spot, namely, Rahul Kumar and Raju Kumar. On the basis of confessional statement of apprehended co-accused persons, the name of petitioners sprang up in this case, as the persons who fled away from the place of

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in the present case. It is also submitted that there is no specific allegation against the petitioners. The petitioners are neither apprehended from the spot nor anything incriminating has been recovered from the conscious possession of the petitioners. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra in connection with Baniyapur P.S. Case No. 452 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
