The petitioner has prayed for bail in connection with Mohiuddin Nagar P.S. Case No. 177 of 2022 instituted for the offence under Sections 302 , 201 and 34 of the Indian Penal Code.

Prosecution case relates to commission of murder of one unknown lady by the co-accused persons along with this petitioner. It is further alleged that this petitioner along with other co-accused persons was apprehended by the police from where the dead body of the woman was recovered and there has been recovery of one knife and one motorcycle were recovered which were used in the murder.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.39302 of 2023(3) dt.08-08-2023 2/2 that petitioner has been falsely implicated in this present case due to village politics. It is further submitted that there is no motive of murder of the said lady. Moreover, he is languishing in judicial custody since 16.07.2022.

Learned APP appearing for the state has opposed the prayer of regular bail and submitted that the petitioner was apprehended by the police with the dead body of the lady along with knife and motorcycle and during investigation vide para12, 13 and 14 of the case diary, several eye witness supported the prosecution version. It is also submitted that postmortem report also corroborated the prosecution case. Having heard the learned counsel for the parties and considering the nature of allegation, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial court is directed to expedite the trial and conclude the same as soon as possible.
