The petitioner seeks bail in a case instituted for the offences under Sections 420 and 409 of the Indian Penal Code.
It appears from the First information Report that petitioner has taken loan from the Bank for the purposes of giving money to the farmers but same has not been returned. Learned counsel for the petitioner submits that in cash credit scheme the Bank has issued a cheque directly to the farmers and after purchase of the paddy the PACS supplied paddy to the State Food and Civil Supply Cooperation and from where the cheque is directly issued to the concerned
Patna High Court Cr.Misc. No.49902 of 2015 (2) dt.09-11-2015 Bank. There is no role of Chairman of Pacs in dealing with the cash. This Court is not examining the process of cash credit scheme. This Court has granted anticipatory bail to the petitioners, namely, Fulendra Singh and Virmani Dwivedi vide Cr. Misc. No.s 12983 of 2015 and 16607 of 2015 respectively.
Having considered the facts and circumstances of the case, let petitioner, Ajay Singh, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Daudnagar, Aurangabad in Haspura P.S. Case No. 104 of 2014.
However, it is made clear that the Bank or State may take steps for realization of the amount.
