JUSTICE SANDEEP KUMAR ORAL ORDER 03-08-2022 Heard the parties This application has been filed for modification of the order dated 05.04.2022 passed in Cr. Misc. No. 15782 of 2022 by which the petitioner has been granted anticipatory bail on certain conditions.

In the circumstances, the order dated 05.04.2022 passed in Cr. Misc. No. 15782 of 2022 is recalled and the same is being replaced by following order.

"Heard the parties.

The petitioner apprehends his arrest in connection with Complaint Case No. C1-750 of 2020 registered for the offence under Section 498-A of the

Patna High Court CR. MISC. No.36390 of 2022(2) dt.03-08-2022 2/2 Indian Penal Code.

Learned counsel for the petitioner submits that the opposite party no.2 has re-married with another person.

Considering the submission that the opposite party no. 2 has re-married with another person, this application is allowed.

Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sitamarhi in connection with Complaint Case No. C1-750 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C."

With the aforesaid modification in the order dated 05.04.2022 passed in Cr. Misc. No. 15782 of 2022, this application is allowed.
