The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act.
The prosecution case is that the petitioner dragged the father of the informant Yogendra Prasad Singh and on the order of this petitioner co-accused Robin Singh shot at the temple of the father of the informant.
It is submitted by learned counsel for the petitioner that only one lacerated wound has been found on the right temporal region of the informant which is alleged against
Patna High Court Cr.Misc. No.4253 of 2016 (2) dt.30-01-2016 2/2 co-accused Robin Singh. There is no dragging injury found by the doctor when it is alleged against the petitioner that he dragged the father of the informant.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Chitragupta Nagar) P.S. Case No. 582 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
