2. The petitioners are apprehending their arrest in connection with Revilganj P.S. Case No. 93 of 2022 for the offence under Sections 341, 323, 324, 307, 504 and 34 of the I.P.C.

3. As per the prosecution story, the informant has alleged that on 15.03.2022, when he was at his Palani (hut), due to previous enmity all the F.I.R named accused persons along with the present petitioners came there and started abusing the informant. It is further alleged that petitioner no. 1 namely, Ravi kumar has assaulted the informant by means of sword on the head and right hand and petitioner no. 2 namely, Mithun

Patna High Court CR. MISC. No.47288 of 2024(5) dt.24-02-2025 2/3 Chaudhary, assaulted the informant by means of knife on right hand. Other accused persons has also assaulted the informant by means of Lathi Danda and thereafter, set the Palani (hut) on fire.

4. Learned counsel for the petitioner submits that the petitioner is innocent and they have falsely been implicated in this case. Due to previous enmity between the parties, this case was filed. So far as injuries found on the person of informant and others are concerned, some of them are simple in nature and opinion is reserved about some injuries till today. There is general and omnibus allegation against some of the other coaccused assaulting with Lathi-Danda.

5. Learned APP opposes the prayer for bail.

6. On perusal of F.I.R., it appears that there is specific allegation against the petitioners of assaulting on the right elbow by means of knife/sword. Injury of Meghnath is also mentioned in para 34 of the case diary which suggests that injury has been found as simple in nature by the doctor concerned. Keeping in view the aforesaid facts, this Court is inclined to extend him the privilege of anticipatory bail.

7. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the

No.47288 of 2024(5) dt.24-02-2025 3/3 receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra, in connection with Revilganj P.S. Case No. 93 of 2022 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
