The petitioner is in custody in a case registered under Sections 399/402 of the Indian Penal Code and 25(1-b)a,26 and 35 of Arms Act.

It is alleged that from the possession of the petitioner one loaded Desi Katta, one live cartridge and one mobile were recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.4.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. As per allegation, one loaded country made pistol and one live cartridges are said to

Patna High Court Cr.Misc. No.38572 of 2015 (3) dt.08-10-2015 2/2 have been recovered from the possession of the petitioner. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga in (Darbhanga) Sadar P.S.Case No. 152/2015.
