JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.
The prosecution case is of robbing the loaded truck after sedating the driver and the cleaner leading to registration of First Information Report against 6-7 unknown. The name of the petitioner sprang up during investigation on the confession of Subodh Kumar.
It is submitted by learned counsel for the petitioner that co-accused Subodh Kumar on whose confession the name of the petitioner sprang up, has been granted regular bail.
A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.4915 of 2016 (2) dt.05-02-2016 2/2 consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Gaurichak P.S. Case No. 199 of 2014, pending in the Court of learned Additional Chief Judicial Magistrate, Patna City. With the observations above, the application stands disposed off.
