JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-08-2019 This is an application for grant of anticipatory bail in connection with Turkauliya P.S. Case No. 481 of 2018, disclosing offences under Sections 341, 147, 148, 149, 323, 325, 307, 427 and 506 of IPC.

Allegation against the petitioners is that they came variously armed to the land of the informant along with his family members and damaged his boundary wall, when the informant objected, petitioner Bhola Sahani assaulted him on his head, causing injury and he again fired on his head, but the same could not hit him, then again fired causing injury on his hand by butt of the pistol.

Submission of the learned counsel for the petitioners

Patna High Court CR. MISC. No.34263 of 2019(3) dt.02-08-2019 2/2 is that there is land dispute between the parties and there is a case and counter case between the parties. Moreover, injuries are simple in nature.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkauliya P.S. Case No. 481 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
