The petitioner seeks bail in a case instituted for the offences under Sections 304(B) and 201/34 of the Indian Penal Code.

As per allegation the victim was married with Jalandhar Yadav, son of the petitioner. Rinku Devi the victim has died whereupon an FIR has been lodged by the brother making allegation that all the family members have demanded a motor cycle which could not be satisfied that led to commission of murder by the petitioner and other family members. Learned counsel for the petitioner submits that victim lady was ill and she was brought to A.N.M.M.C Hospital,

Patna High Court Cr.Misc. No.48916 of 2015 (2) dt.05-11-2015 Gaya on 27.10.2004. There she was treated and she died on account of cardio respiratory failure. It has been submitted that certain witnesses have stated that the victim was ill and on that account she has died.

Having considered the facts and circumstances of the case, let petitioner, Kameshwar Yadav, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in connection with Neemchak Bathani P.S. Case No.127 of 2014.
