2. The petitioner has preferred this application for grant of regular bail in connection with Bihariganj P.S. Case No. 354 of 2024, dated 17.10.2024 registered for the offences punishable under Sections 137(2) and 96 of the BNS.
3. As per the prosecution case, the minor daughter of informant was alleged to have been kidnapped by the petitioner and other co-accused person Saurav Kumar. The informant tried to search for his daughter everywhere but he could not find her and when he went to other co-accused persons who are relative of co-accused Saurav Kumar and requested them to return his minor daughter, they tortured him
Patna High Court CR. MISC. No.37706 of 2025(2) dt.24-06-2025 2/3 and abused him by his caste name and refused to return his daughter.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The alleged occurrence took place on 14.10.2024 but the FIR has been instituted on 17.10.2024, after a delay of three days without giving any explanation for the said delay. The victim girl was recovered and her statement was recorded under Section 183 of the BNSS in which she has not stated anything regarding her forceful kidnapping or establishing sexual relationship with any of the co-accused person, rather she went with the co-accused persons out of her own sweet will. In fact, there was a love affair going on between the victim girl and coaccused Saurav Kumar. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 25.12.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand
Patna High Court CR. MISC. No.37706 of 2025(2) dt.24-06-2025 3/3 Only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Udakishunganj, Madhepura, in connection with Bihariganj P.S. Case No. 354 of 2024.
