JUSTICE JYOTI SARAN ORAL ORDER 10-11-2015 Learned counsel is permitted to make appropriate correction in paragraph-1 of the bail application to include the accusations made under the Arms Act.

Heard Mr. Surendra Kumar Singh for the petitioners, learned counsel for the State and learned counsel for the informant.

The two petitioners are in custody in connection with Udwantnagar P.S. Case No. 228 of 2015 for offence punishable under Sections 147, 148, 149, 341, 504 and 307 of the Indian Penal Code and Section 27 of the Arms Act.

The two petitioners along with other accused have been charged with assaulting the prosecution party and causing fire arm injury. Mr. Surendra Kumar Singh, learned counsel for the

Patna High Court Cr.Misc. No.50566 of 2015 (2) dt.10-11-2015 petitioners with reference to the FIR has submitted that dispute is relatable to easementary rights and in which process seven accused have been charged with assault including the two petitioners. He submits that even when a sweeping allegation has been made against accused persons but two of them, namely, Ramadhar Singh and Sanjay Singh have been charged with causing fire arm injury on Hare Krishna Singh and Ram Bhagwan Singh respectively. He submits that insofar as the other persons are concerned, an omnibus allegation regarding firing has been made. He further submits that the two petitioners have clean antecedents.

Having heard learned counsel for the parties and considering the nature of allegation as well as antecedent of the petitioners, let two petitioners, namely, Dhananjay Singh and Rahul Kumar be released on bail upon each of them individually furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur at Ara in connection with Udwant Nagar P.S. Case No. 228 of 2015.
