The petitioner apprehends his arrest in Complaint Case No. 337/2014, registered for the offences punishable under Section 4 the Dowry Prohibition Act.
The complainant alleged that the marriage of the petitioner was settled with the daughter of the complainant. The engagement ceremony was performed, but due to demand of dowry negotiation was broken.
The learned counsel for the petitioner submits that the petitioner is the bridegroom. He never took any money from the complainant. At the time of engagement the petitioner saw the
Patna High Court Cr.Misc. No.21973 of 2015 (3) dt.08-10-2015 2/2 bride, but did not like her and that is why the petitioner refused to marry. The petitioner is S.I. in C.R.P.F.
Learned counsel for the complainant vehemently opposed the prayer for anticipatory bail.
Having considered the facts aforesaid and the fact that the petitioner did not receive any money from the complainant rather money was taken by brother of the petitioner, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Saran, Chapra in connection with Complaint Case No. 337/2014, subject to the conditions as laid down under Section 438(2) of the Cr.
