The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

Accusation is of kidnapping the minor daughter of the informant. In 164 Cr.P.C. statement the victim has got her age recorded as 15 years when the learned court below has assessed her age as such, though as per the medical report she was found between 15-16 years wherein she has stated that she was not kidnapped rather she of her own went in the company of the petitioner and has performed marriage with him and after attaining majority she wants to reside with the petitioner. Considering the 164 Cr.P.C. statement of the victim

Patna High Court Cr.Misc. No.3964 of 2016 (3) dt.04-02-2016 2/2 girl, it is a case for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Forbesganj P.S. Case No.494/2015, pending before the learned CJM, Araria. With the above observation, this application is, accordingly, disposed off.
