JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-10-2015 Both the bail applications arise out of Chakiya P.S. Case No. 283 of 2014 registered under sections366, 366A, 368, 376/34 of the Indian Penal Code and accordingly both the applications have been heard together and are being disposed of by this common order.
Patna High Court Cr.Misc. No.20782 of 2015 (3) dt.08-10-2015 2/2 In both the petitions petitioners are named in the first information report. The accusation against petitioner in Cri. Misc. No. 20782 of 2015 is that he forcefully established physical relation with the informant whereas petitioners in Cri. Misc. No. 21831 of 2015 are said to have exploited the informant. The statement of informant was recorded under section 164 Cr.P.C. in which she stated a different story. The informant in her fardbeyan stated that she was dropped by petitioners in Cri. Misc. No. 21831 of 2015 at unknown place but in her statement recorded under section 164 Cr.P.C, she stated that she was dropped by one Naresh at Muzaffarpur. Further more when further statement of informant was recorded at paragraph 3 of the case diary she stated that taking advantage of circumstances, petitioner in Cri. Misc. No. 20782 of 2015 established physical relation with her.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioners in both the bail applications be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Motihari in Chakiya P.S.
