JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 272 and 273 of the Indian Penal Code and 47 A of the Excise Act. The prosecution case is that from an auto-rickshaw 48 litres of Mahua liquour was recovered. Two persons were apprehended namely, Raju Kumar and Jiten Manjhi who disclosed that the liquour was supplied by this petitioner. It is submitted by the learned counsel for the petitioner that admittedly recovery has not been made from the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has got no criminal antecedent.
Considering the facts that recovery has not been made
Patna High Court Cr.Misc. No.4073 of 2016 (3) dt.01-02-2016 2/2 from the petitioner, let the above-named petitioner, in the event of arrest or surrender before the learned court below within a period of 12 weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No. 469/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Dinesh Kumar Singh, J.) Vinita/- U T
