2. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 26/41/42 of the Indian Forest Act and Sections 27/29/31 of the Wildlife Protection Act.
3. A truck loaded with Mica was seized by the Forest Authority and the petitioner is said to be the owner of the said truck.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that nothing has been recovered from the physical conscious possession of the petitioner and his name has been dragged on the basis of enmity due to village politics. He
Patna High Court CR. MISC. No.38681 of 2024(2) dt.10-07-2024 2/2 submits that the petitioner has no concern with the truck nor the article loaded on it. He further submits that petitioner has criminal antecedents of similar nature as stated in para-3 of the bail application.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case and the fact that the petitioner has criminal antecedent, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Nawada Government Official Complaint (G.O.) Case No. 228 of 2023.
