Petitioner seeks bail in Araria (RS) P.S. Case No.455 of 2018 instituted for the offence under Section(s) 394 Indian Penal Code.

It is alleged that the informant had gone to cattle fair to purchase two buffaloes. It is further alleged that three miscreants snatched rupees fifty thousand from the pocket of the informant. The villagers chased the miscreants. The petitioner and another accused was apprehended by the villagers. The villagers after taking back money from them returned the same to the informant.

Counsel for the petitioner submits that petitioner has

Patna High Court CR. MISC. No.39106 of 2019(3) dt.30-07-2019 2/2 been made accused in this case only on suspicion. Investigation is complete and charge-sheet has already been submitted against the petitioner. There is no seizure list with the First Information Report to substantiate that looted amount and bag has been recovered from possession of the petitioner.

Petitioner is in custody since 01.09.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Araria (RS) P.S. Case No.455 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
