The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and (c) of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 10 litres of Mahua liquor was recovered from the house of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession or house of the petitioner. He has been falsely implicated in the case because of his antecedent. He was not caught at the place of occurrence. He is in custody since 27.3.2021 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.48922 of 2021(3) dt.29-03-2022 2/2 taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Buniyadganj P.S. Case no.22 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cum-Special Judge, Excise Act, Gaya.
