JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-05-2019 Heard learned counsel for the petitioners and learned learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with Koransarai P.S. Case No. 10 of 2019 for the offenses under Sections 304(B), 201/120(B) of the Indian Penal Code. Learned counsel for the petitioners submits that petitioners have no criminal antecedent. The petitioners are in custody since 11.3.2019. He submitted that the marriage took place on 1.5.2008 and the alleged occurrence took place on 13.2.2019 and as such the provisions of Section 304B is not attracted.

Considering the fact that the marriage took place

Patna High Court CR. MISC. No.35043 of 2019(2) dt.28-05-2019 2/2 nearly 11 years back, the court is inclined to grant bail to the petitioners. Let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar in connection with Koransarai P.S. Case No. 10 of 2019.
