23-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Kathaiya P.S. Case No. 133 of 2020, registered for the offence under Sections 356, 379, 34 of the Indian Penal Code.

As per the prosecution case, on 09.11.2020 at about 5.00 PM, while the informant, after collecting money, reached near a school, two miscreants riding on a motorcycle snatched the bag of informant containing Rupees ninety thousand cash, Aadhar card, voter I-card, Tab, finger machine and his mobile phone and thereafter, fled away.

Petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation. No incriminating article has been recovered from the possession of the petitioner and till date, petitioner has not been put on T.I.P. Petitioner is in custody since 19.12.2020.

Patna High Court CR. MISC. No.48862 of 2021(2) dt.23-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IVth (West), Muzaffarpur in connection with Kathaiya P.S. Case No. 133 of 2020.
