The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 504, 379 and 307 of the Indian Penal Code. The prosecution case is that the petitioners assaulted the informant with iron rod and danda and snatched rupees eight thousand.

It is submitted by learned counsel for the petitioners that the injury has been found to be simple. In fact, the informant pushed a boy by bicycle and on protest he was

Patna High Court Cr.Misc. No.4134 of 2016 (2) dt.29-01-2016 2/2 assaulted by the villagers. The accusation is omnibus and general.

Since petitioner no. 2 is accused in three other cases, let the learned court below consider his prayer for regular bail.

Petitioner nos. 1 and 3 have no criminal antecedent, hence, considering the fact that the accusation is omnibus and general and injury has been found to be simple, let the above named petitioner nos. 1 and 3 be released on anticipatory bail, in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhabua, Kaimur in connection with Mohania P.S. Case No. 03 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
