The petitioner seeks bail in a case registered for the offence punishable under Sections 381,411 of the Indian Penal Code.

Petitioner who happens to be domestic servant of the informant is said to have stolen Rs.82,512/- from the locker of the informant located on his petrol pump and on the disclosure of the petitioner the aforesaid money was recovered from his house by the informant and produced before the police. It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. Petitioner has no concern with the aforesaid occurrence. The petitioner

Patna High Court CR. MISC. No.33824 of 2019(2) dt.23-05-2019 2/2 happens to be maid of the informant and is engaged at the house of the informant and he has no visiting term at his petrol pump. His wages of two years was due to the informant. On demand of the same informant always averted him and on insistence for the same he has falsely implicated the petitioner in the aforesaid false and concocted case. No money was recovered from his house on the basis of his disclosure and said money was not seized by the police rather by the informant and produced before the police. He has no criminal antecedent. He has been languishing in judicial custody since 11.01.2019. Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. V, Bettiah, West Champaran, in connection with Manpur P.S. Case No. 04 of 2019.
