JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 23-02-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Kadwa Police Station Case No. 155 of 2015, disclosing offences under Sections 147, 149, 341, 323, 504, 324, 307 and 379 of the Indian Penal Code.
It is stated at the very outset that petitioner no. 6, namely, Md. Kaishar @ Kaisar, has been arrested during the pendency of this application.
This application to the extent it relates to
Patna High Court Cr.Misc. No.5983 of 2016 (2) dt.23-02-2016 2/3 petitioner no. 6, Md. Kaishar @ Kaisar, has become infructuous and accordingly stand dismissed as having become infructuous.
Learned Counsel appearing on behalf of the petitioners submits that the injuries on the informant have been found to have been caused by hard and blunt substance, which belies the case of the prosecution. He further submits that there is counter case, lodged by petitioner no. 5, Md. Azad @ Azad.
Considering the nature of dispute and accusation, as also the fact that the petitioners have no criminal antecedents, this application is allowed. Let the petitioners, namely, Md. Jiaul @ Jiaul, Md. Jamil @ Jamil, Md. Ezahar @ Ezahar, Md. Majnu @ Majnu, Md. Azad @ Azad, Bibi Sahari Khatoon @ Sahari Khatoon, Bibi Jinia Khatoon @ Jinnat @ Jinia Khaton and Bibi Nazera Khatoon @ Nazera Khatoon, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate IV, Katihar, in connection with Kadwa Police Station Case No. 155 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal

This is subject to the condition that the petitioners shall present themselves before the police/ Court, as the same may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
