This is a petition for grant of regular bail in a case under Sections 392 and 412 of the Indian Penal Code. It is alleged that the informant after closing his shop at Chhouradano was going to his house on black colour Bajaj Platina motorcycle and on way three armed persons snatched his motorcycle, Rs.5,000/- and two mobiles and ran away. The First Information Report has been registered against three unknown persons.
It is submitted that neither any recovery has been made from the possession of the petitioner nor Test Identification Parade has been conducted and the only material is the confessional statement of the co-accused.

No.50103 of 2015 (3) dt.09-02-2016 Hence, having regard to the facts and circumstances of the case, the petitioner above named is ordered to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Motihari, East Champaran in connection with Adapur P. S. Case No. 14 of 2015, subject to the condition that one of the bailors shall be a close relative of the petitioner who will file affidavit to the effect that the petitioner shall not involve in such type of activity in future and if any report is received regarding his involvement then the bail bond of the petitioner shall stand cancelled and further the petitioner shall file Hazri in the nearest police station once in a fortnight for one year.
