JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2022 Heard learned senior counsel for the petitioner and learned APP for the State through video conferencing. The petitioner seeks bail in connection with S.T. No.92 of 2020 arising out of Barhara (Raghubansh Nagar) P. S. Case No.62 of 2019, instituted for the offences under Sections 302, 120B/ 34 of the Indian Penal Code and Section 27 of the Arms Act.

The learned senior counsel for the petitioner submits that the petitioner is in custody since 19.06.2020 and charge-sheet has been submitted in the case. The learned senior counsel for the petitioner submits that the allegation is of murdering of the brother of

The learned senior counsel further submits that there is no eye witness to the alleged occurrence and similarly situated co-accused persons have been granted bail as has been stated in Para-20 of the bail application along with other accused persons, who have been granted bail Babloo Sah by order dated 22.09.2021 in Cr. Misc. No.49915 of 2021 and Sintu Mehra by order dated 13.12.2021 in Cr. Misc. No.33878 of 2021.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 19.06.2020, charge-sheet has been submitted in the case and similarly situated co-accused have been granted bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Purnia in connection with S.T. No.92 of 2020 arising out of Barhara (Raghubansh Nagar) P. S. Case No.62 of 2019, subject to

Patna High Court CR. MISC. No.46652 of 2021(2) dt.06-01-2022 3/3 condition that one of the bailers shall be the Mausa (Guddu Kumar) of the petitioner.

The application stands allowed.
