2. The petitioner seeks regular bail in connection with Siwan Mahila Thana P.S. Case No. 19 of 2025, lodged on 16.03.2025, under Sections 64(1), 351(3) and 303 (2) of the Bharatiya Nyaya Sanhita, 2023, pending before the Court of S.D.J.M., Siwan / Successor Court.

3. As per the prosecution, the informant has alleged that the petitioner entered her house at gunpoint and committed rape.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the medical report of the informant, conducted on 16.03.2025, does not indicate any evidence of

It is also submitted that the statement of the informant under Section 164 of the Cr.P.C. is not available on record and may be called for. Counsel also submits that the petitioner has been in custody since 16.03.2025 and has clean criminal antecedent.

5. Learned APP for the State opposes the prayer for bail and submits that the informant has made a specific allegation of rape at gunpoint against the petitioner. Counsel further submits that the Sessions Court, while passing the order, has observed various statements recorded in the case diary, particularly acknowledging the direct and specific allegation made by the informant against the petitioner regarding the commission of rape.

6. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
