The petitioner is in custody in connection with Nawada Town P.S. Case No. 375 of 2019 for the offences under Sections 406, 420 of the Indian Penal Code and Section 37(B) of Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 03.04.2019. He further submits that allegation against this petitioner is that he was involved in changing the ATM Card of the mother of the informant. He further submits that petitioner was apprehended when he was allegedly in a drunken condition. Considering the fact that nothing was recovered from the conscious possession of the petitioner, the Court is inclined
