In pursuance to the order dated 24.09.2021, status report of trial in connection with Special Case No. 13 of 2019 arising out of Barharia P.S. Case No. 61 of 2017 has been received and kept at Flag-X, in which it is reported that out of seven charge-sheet witnesses, four witnesses have been examined so far. The case is pending for prosecution evidence. It is further reported that the trial of the aforesaid case is likely to be concluded within four months.
Considering the present stage of the trial, I am not inclined to enlarge the appellant on bail. Accordingly, his payer for bail is rejected in connection with Special Case No. 13 of 2019 arising out of Barharia P.S. Case No.61 of 2017 pending before the court of the learned Additional Sessions Judge-1cum-Special Judge, SC/ST, Siwan.
Patna High Court CR. APP (SJ) No.3315 of 2021(5) dt.02-12-2021 2/2 Accordingly, the appeal is dismissed. However, Trial Court is directed to conclude the trial as expeditiously as possible within a period of four months from the date of initiation of normal physical proceeding and /or through Video Conferencing and S. S.P., Patna is directed to ensure production of the witnesses in the case on each and every date fixed without fail. Appellant is at liberty to renew his prayer for bail if the trial is not concluded within the stipulated period. (Anjani Kumar Sharan, J) devendra/- U T
