As the informant who happens to be an Executive Engineer did not concede to oblige a contract, in the aforesaid background it has been alleged by him that two persons intruded in his chamber, fired having meticulous escape. Furthermore, he did not claim identification of both the culprits. However, just thereafter he received call and one Samir Ansari took responsibility for the aforesaid event. Admittedly, petitioner is not named in the FIR. From perusal of the case diary, it is evident from para-24 that two persons were apprehended who disclosed their identity as Aman Srivastava and Md. Sabbir @ Pandit who, during course of their inculpatory extra judicial confessional statement shown complicity along with the petitioner however, during course of investigation none of them has been put on T.I. Parade to ascertain their identity.

Patna High Court Cr.Misc. No.53811 of 2015 (3) dt.30-01-2016 Though, petitioner has got criminal antecedent but in the facts and circumstances of the case, petitioner Raju Rose @ Raju Ro is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No.776 of 2013.
