JUSTICE BIRENDRA KUMAR ORAL ORDER 28-09-2021 This matter has been taken up for out of turn hearing as the petitioner had mentioned in the mentioning slip that his mother, aged about 62 years, is suffering from heart ailment. In support of the submission prescription of the Doctor was attached with the mentioning slip.
Heard learned counsel for the parties.
Let the defect(s), if any, be removed within four weeks. Petitioner seeks bail in a case registered for the offences punishable under Sections 498(A), 323, 325, 307/34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. Petitioner is husband of the informant and allegation is of demand of dowry and torture for the same. Petitioner is in custody since 18.06.2021.
Considering the period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond
Patna High Court CR. MISC. No.46260 of 2021(2) dt.28-09-2021 2/2 of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sonepur Police Station Case No. 294 of 2021, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
(c) The petitioner shall not leave the country without permission of the learned trial court.
(d) The petitioner shall file affidavit before the court below at the time of furnishing bail bond that if his wife desires to reside in the house of the petitioner, the petitioner shall not misbehave with her and shall not commit any physical assault against her, otherwise that would be a ground for cancellation of bail of the petitioner.
