Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 467, 468, 471, 34 of the Indian Penal Code.
As per FIR, petitioner is alleged to have obtained appointment on the post of Special Survey Amin on the basis of forged and fabricated documents.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and after petitioner was appointed to the post of Special Survey Amin by the competent authority after proper verification. Moreover, petitioner has already tendered his resignation from the service, as per Annexure 2 series. It is further submitted that similarly situated co-accused persons
Patna High Court CR. MISC. No.40345 of 2023(3) dt.19-08-2023 2/2 have been granted bail by this Hon'ble Court (Annexure 3 series). Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate - I, Sheikhpura in Ariyari P.S. Case No. 14 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
