This application for anticipatory bail arises out of Dumra P.S. Case No. 301 of 2018, disclosing offences under Sections 420, 467, 468 and 471 of the Indian Penal Code. The allegation against the petitioner is of having attempted to get compassionate appointment on the basis of the certificates, which were found to be forged.

Learned counsel for the petitioner has submitted that since the accusation is based on the documentary evidence, there is no likelihood of tampering with the evidence. It has also been argued that the petitioner was not given appointment on compassionate ground.

In the facts and circumstances of the case, this

Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned CJM, Sitamarhi in connection with Dumra P.S. Case No. 301 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
