The petitioners being aunt and uncle of the husband of informant are apprehending arrest in a case registered for the offences punishable under Sections 323, 379, 307, 498A and 504/34 of the Indian Penal Code.
Basic accusation is of torture and on the order of petitioner no.2 an attempt was made to cause burn injury to the informant.
It is submitted by learned counsel for the petitioners that the petitioners claim to be separate from the husband of the informant and from the FIR itself it appears that no injury was caused to the informant.
Considering the aforesaid facts, let the above named
Patna High Court Cr.Misc. No.6309 of 2016 (2) dt.09-02-2016 2/2 petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhubani, in connection with Basopatti P.S. Case No.66/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
