JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 457/380 of the Indian Penal Code.

As per the prosecution case, unknown miscreants committed theft and looted valuable articles including cash of Rs.22,000/- from the house of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner is not named in the FIR. Petitioner's name has figured during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 13.6.2021. Investigation is complete.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Gogari Police Station Case No. 255 of 2021/GR No.1829 of 2021.
