The petitioner is languishing in custody since 25-09-2018 in a case registered for the offence punishable under Section 379 of the I.P.C.
It is alleged that on the informant's motorcycle being stolen, the F.I.R. was lodged against unknown. The name of the petitioner sprang up during investigation. It is further alleged that the stolen motorcycle was recovered from the possession of the petitioner.
It is submitted by learned counsel for the petitioner that only on the basis of suspicion, the petitioner has been made accused in the present case. However, he is accused in two other cases in which he is on bail.
Learned APP submits that the stolen motorcycle was recovered from the possession of the petitioner and the

Considering the fact that the investigation has already concluded and the period in custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st class, Kishangaj in connection with Kishanganj P.S. Case No 565 of 2018. The learned Court below will be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in similar nature of offence.
