Patna High Court Cr.Misc. No.25485 of 2015 (3) dt.08-10-2015 2/3 disposed of by this common order.
Heard learned counsel for the petitioners, learned counsel for the E.O.U. and learned A.P.P. representing the State. Petitioners seek bail in connection with Economic Offence P.S. Case No. 23 of 2012 registered for the offences punishable under Sections 420, 468, 472 and 120(B) of the Indian Penal Code.
The petitioners are not named in the First Information Report but during course of investigation, the carbon copy of the answer-sheet (O.M.R.) was recovered from flat of co-accused Ranjeet Kumar Rajak. Admittedly, the flat owner Ranjeet Kumar Rajak has already been granted privilege of anticipatory bail by another Bench of this Court and several co-accused persons who were caught near the strong room, have also been granted bail by a co-ordinate Bench as well as learned lower court itself. Similarly situated co-accused Prem Chandra @ Premchand has also been allowed bail vide order dated 01.10.2015 passed in Criminal Misc. No. 47247 of 2015 by another co-ordinate Bench of this Court. The learned counsel for Economic Offence Unit does not oppose.
In the facts and circumstances stated above, both the petitioners above named are directed to be released on bail on
Patna High Court Cr.Misc. No.25485 of 2015 (3) dt.08-10-2015 3/3 execution of bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Patna arising out of Economic Offence P.S. Case No. 23 of 2012 subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioners shall remain present on each and every date during trial and the default on two consecutive dates on their part without any reason shall disentitle the petitioners from privilege of bail.
