Petitioner is accused in connection with Sonepur Rail P.S. Case No.69 of 2014 registered under Sections 399, 402, 414 of the I.P.C. and 25(1-B)A, 26/35 of the Arms Act. The accusation is that the petitioner and one Ganesh Mahto were apprehended by the Police in suspicious condition whereas 4-5 persons were succeeded to flee away. In course of search, petitioner was found in possession of one knife and his associate Ganesh Mahto was found in possession of one country made pistol.
Learned counsel appearing on behalf of the petitioner submits that in fact, petitioner is accused in two other cases, due to
Patna High Court Cr.Misc. No.50726 of 2015 (2) dt.04-02-2016 2/2 that reason, petitioner has falsely been implicated in this case showing his recovery of the knife. It is also submitted that petitioner is in custody since 06.09.2014.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of IXth Additional Sessions Judge, Saran at Chapra in connection with Sessions Trial No. 624 of 2014 arising out of Sonepur Rail P.S. Case No.69 of 2014.
