This application for grant of anticipatory bail arises out of Hathauri P.S. Case No. 14/2015, disclosing offences under sections 147, 148, 149, 325, 326, 307 and 448 of the Indian penal Code.

The petitioner is a lady.

Learned counsel for the petitioner submits that eight persons have been named in the First Information Report. The allegation of assault is against co-accused, Jugeshwar Sahni. He further submits that similarly situated co-accused persons have been granted anticipatory bail by this Court vide order dated 3.11.2015 passed in Cr.Misc.No. 32239/2015.

Patna High Court Cr.Misc. No.5395 of 2016 (2) dt.09-03-2016 Considering the submission that similarly situated coaccused persons have been granted anticipatory bail and that the petitioner is a lady, this application is allowed. Let the petitioner, abvoenamed, in the event of her arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub JudgeX, Muzaffarpur in Hathauri P.S.Case No. 14/2015, subject to the conditions as laid down under section 438(2) Cr.P.C.

This is subject to the condition that the petitioner shall present herself before the police/ court, as the case may be, as and when required and in the event of failure on her part to appear before the court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
