The petitioner seeks bail in Rajeev Nagar P.S. Case No. 199 of 2021, registered for the offence punishable under Sections 420, 188 of the Indian Penal Code, section & of the Essential Commodities Act and section 3 of the Oxygen Gas Cylinder Act and section 3 of the Epidemic Act. As per the prosecution case, this petitioner along with other accused persons indulged in blackmarketing of oxygen gas cylinder.

It is submitted on behalf of the petitioner that petitioner has been made accused in this case on the basis of confessional statement of co-accused Harsh Raj. No oxygen gas cylinder has been recovered from possession of this petitioner.

Patna High Court CR. MISC. No.47040 of 2021(2) dt.18-11-2021 2/2 Petitioner claims clean antecedent and he is in custody since 11.05.2021. Chargesheet has already been submitted. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Patna in connection with Rajeev Nagar P.S. Case No. 199 of 2021.
