10-11-2015 Heard Sri Vishwanath Prasad Singh, learned senior counsel, who was assisted by Sri Prabhash Ranjan Thakur, learned counsel for petitioners and learned Addl. Public Prosecutor. Two petitioners, who are in custody in Lakhisarai P.S. Case No. 515 of 2015 registered for the offence under Section 414 of the Indian Penal Code and Sections 25(1-B)a/26/35 of the Arms Act, 1959, have prayed for grant of bail.
It was submitted that petitioner no. 1 was driver of the vehicle and petitioner no. 2 was neighbour of the petitioner no. 1 and in the said vehicle, husband of the owner was also there. However, on allegation that two loaded country-made gun alongwith two empty cartridges were recovered from the vehicle,
Patna High Court Cr.Misc. No.50746 of 2015 (2) dt.10-11-2015 2/2 the petitioners were arrested. They are in custody since 20th July, 2015. It has been indicated in paragraph - 3 of the petition that petitioners are having clean antecedent.
In view of nature of accusation and period of custody, let both the petitioners namely Raj Kumar Rai and Akshay Lal Ram be released on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai/concerned court in connection with Lakhisarai P.S. Case No. 515 of 2015.
